Terms of Service

1. The Service

audioguia.ai is a software-as-a-service (SaaS) platform that enables museums, churches, galleries, zoos, aquariums, and other cultural venues to create AI-voiced audio guides and distribute them to visitors via QR codes.

By registering and using audioguia.ai you agree to these Terms of Service in full. If you disagree with any part, you must stop using the service.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and all activity on your account. Notify us immediately of any suspected unauthorized access at hola@audioguia.ai.

3. Trial Period & Subscriptions

3.1 Free trial

New accounts receive 14 days of full Pro access without requiring a credit card. At the end of the trial, the account enters a 30-day grace period during which your published guides remain visible to visitors but new content generation is suspended.

3.2 Account lifecycle

• Days 1–14: Full Pro access (trial).
• Days 15–44: Grace period — published guides stay live; new generation suspended.
• Day 45: Guides go offline without an active subscription.
• Day 75: Permanent data deletion if no subscription is activated.

3.3 Billing

Subscriptions are billed monthly or annually per the chosen plan. Payments are processed via Stripe. Billing currency is locked at first subscription and cannot be changed during the current period.

3.4 Cancellation

You may cancel your subscription at any time from the billing portal. Access continues until the end of the billed period. No prorated refunds are issued for unused periods.

4. Narraciones (Audio Credits)

The billing unit is the narración: one AI-generated audio file for one stop in one language. A long stop (over 500 words) counts as 2 narraciones. Custom audio uploads do not consume narraciones.

25% of unused narraciones roll over to the next month (maximum one month of accumulation). Narraciones have no cash value and are not refundable.

Tours are free containers. Visitor plays are unlimited and free at all plan tiers.

5. Curator Content

5.1 Content responsibility

You are solely responsible for all content you publish through audioguia.ai, including scripts, audio, and any AI-generated or AI-assisted material. This includes ensuring content is accurate, does not infringe third-party rights, and complies with applicable law.

5.2 AI-generated content

Scripts generated by the AI assistant and audio generated by ElevenLabs are support tools. audioguia.ai does not guarantee the historical, cultural, or factual accuracy of AI-generated content. It is your responsibility to review and approve all content before publishing.

5.3 Content ownership

You retain ownership of original texts you write. By using the service, you grant us a limited, non-exclusive, revocable license to host, process, and deliver your content solely for the purpose of operating the service.

5.4 Prohibited content

You must not publish content that:

• Infringes copyright, trademarks, or other intellectual property rights.
• Is false, misleading, or fraudulent.
• Contains pornographic, violent, or hateful material.
• Violates applicable local, national, or international law.

6. Platform Intellectual Property

audioguia.ai, its source code, design, brand, logos, and underlying technology are the exclusive property of the audioguia.ai operator. Nothing in these Terms grants you rights over the platform beyond use of the service as described here.

7. Suspension & Termination

We may suspend or terminate your access, with or without notice, if you breach these Terms, use the account fraudulently, fail to cure a payment failure within 7 business days, or if required by law. On termination for breach, no refunds will be issued and you will have 30 days to export your content before permanent deletion.

8. Limitation of Liability

To the maximum extent permitted by applicable law, audioguia.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, business, or data, even if advised of the possibility of such damages.

audioguia.ai's total liability to you for any cause shall not exceed the amount you paid in the 3 months prior to the event giving rise to the claim. The service is provided "as is" and "as available."

9. Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified by email at least 15 days in advance. Continued use after notification constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the competent courts of Mexico City, unless otherwise expressly agreed.
